By using the Site you agree to the following terms and conditions (the "Terms of Use”). Please read them carefully. Your attention is specifically drawn to sections 4 (”Submitting Material to the Site”), 5 (”Privacy Policy), 8(”Links”), 9 (”Disclaimer”), and 10 (”Limitation of Liability”).

 

1. These terms of use 

1.1 Access to the Site and the information and materials contained in it is provided to you under the Terms of Use. If you use the Site in any way, you will be taken to have agreed to the Terms of Use. If you do not agree with the Terms of Use do not use this Site. If you do use the Site, your conduct indicates that you agree to be bound by the Terms of Use.

 

1.2 ETI may change the Terms of Use from time to time. ETI will notify you of any changes by posting them on the Site or through other reasonable means of providing notice. Any changes to the Terms of Use will be effective immediately upon such notice. You are responsible for reviewing regularly information posted online to obtain timely notice of such changes. If you use the Site after notice of changes to the Terms of Use, you will be taken to have agreed to the changes.

 

2. Use of the site

2.1 In order to access certain areas of the Site, you will be asked to complete a User profile. Depending on your selected member type, ETI may consider the information you have provided and make a decision as to whether to accept you as a User of restricted areas of the Site. Such decision is entirely at ETI’s discretion. If you are accepted as a User of restricted areas of the Site, an automatic email from alerts@yourmembership.com informing you of your registration status will be generated.

 

2.2 ETI may at any time, by notice to you, immediately terminate your access to restricted areas of the Site and cancel your User name and password.

 

2.3 You are hereby authorised solely to view and to retain a copy of pages of this Site for your own personal use. You are not permitted to duplicate, publish, modify, or otherwise distribute the material on this Site unless you are specifically authorised to do so in writing by ETI.

 

2.4 Nor are you permitted to use the data to compile subsequent databases, lists or directories, or to contact the individuals or organisations featured on the Site in order to capture or verify this or any other source of data.

2.5 The use of the Site as a source or target for direct marketing, telemarketing, electronic, viral or any other marketing activity on yours, or someone else’s behalf, is prohibited.

 

2.6 You will use the Site and any content, material or information found on the Site solely for your own lawful purposes.

 

2.7 You commit to treating other Users with respect and to taking no actions intentionally to mislead, or defraud other Users of the Site.

 

2.8 You will not intentionally post information that is incorrect or misleading on the Site.  You will amend any information found to be incorrect or misleading within 48 hours.

 

2.9 You commit to upholding the confidentiality of work conducted by Users and not disclosing it to anyone else.

 

2.10 You will not post any derogatory comments on the Site about any other User.

 

2.11 You must not imply on the Site or elsewhere that your use of the Site indicates any endorsement of yourself or your services either by the sponsors of the Site or by any other User of the Site.

 

2.12 You must not use the network to make exclusive commercial arrangements with a User which prevent them from working with other Users.

 

3. Rights in site content

3.1 All content provided by ETI on the Site is protected by copyright, trademark and other applicable intellectual property and proprietary rights laws and is owned by or licensed to ETI.  Tademarks appearing on the Site are the property of their respective owners.

 

3.2 You will not modify, publish, sell, and create derivative works of or in any way exploit any of the content in whole or part found on the Site. You may download and print copyrighted content solely for your own use but will make no other use of the content without the express written permission of ETI. ETI’s status (and that of any identified contributors) as the authors of material on the Site must always be acknowledged. You will not disclose any information contained on the Site to any outside party without the express written permission of ETI. You will not make any changes to any content that you are permitted to download and print and, in particular, you will not delete any proprietary rights or attribution notices in any content. You agree that you do not acquire any ownership rights in downloaded content.

 

4. Submitting material to the site

4.1 The Site allows you to submit material for inclusion on the Site. Whilst ETI does not control the submission of material, ETI does reserve the right to delete, move and edit any material submitted. Publication will be at ETI’s discretion.

 

4.2 You are solely responsible for the material you submit to the Site and by submitting any material you agree to follow these rules. You may not submit any material which:

 

4.2.1 Reveals any confidential or sensitive information.

 

4.2.2 Contains or links to any unlawful, threatening, abusive, defamatory or indecent material or material which is deliberately intended to upset other Users.

 

4.2.3 Contains any material which you do not have permission to use (including material which may be protected by copyright, trademarks, database rights or any other form of intellectual property right).

 

4.2.4 Contains viruses or any other components with harmful or contaminating effects on the Site or any equipment connected to it; or

 

4.2.5 Impersonates any living person.

 

4.3 The Site offers you a blog to submit material and you agree to be responsible for all ETI’s losses arising out any breach by you of these rules.

 

4.4 By submitting material to the Site you are granting ETI a perpetual royalty-free non-exclusive licence to reproduce, modify, translate, make available, distribute and allow others to use any material you submit in whole or in part or in any form. ETI will try to credit authors of the material where possible, but cannot guarantee to do so.

 

4.5 The Site contains material submitted by others over which ETI has no control. ETI has asked all Users to follow these rules but cannot guarantee the accuracy, integrity or quality of other material. ETI does not endorse any of the material published by any others on the Site.

 

5. Privacy Policy

5.1 The ETI/LRN Privacy policy explains how your personal information will be treated. By accepting the Terms of Use and using the Site, you shall be deemed to have accepted the terms of the Privacy policy in full. Changes to the ETI/LRN Privacy policy from time to time will be posted on the Site.

5.2   General

5.2.1 ETI collects personal information about you and your organisation when you create your member profile on the Site. ETI will not rent, sell, or share personal information about you with other people or non-affiliated companies.

5.2.2 We reserve the right to send you certain communications relating to the Local Resources Network, such as service announcements, administrative messages and Newsletters (when subscribed to), that are considered part of your membership of the Site without offering you the opportunity to opt-out of receiving them.

5.2.3 Emails sent through the site, including contact form enquiries, recommendations and review requests are one-off emails. We will not distribute any email addresses to any third party or associated company of ETI or use them for anything other than their intended purpose.

5.3 Confidentiality and Security

5.3.1 We limit access to personal information about you to employees who we believe reasonably need to come into contact with that information to provide products or services to you or in order to do their jobs.

5.3.2 We have physical, electronic, and procedural safeguards that comply with regulations to protect personal information about you including, but not limited to, compliance with the Data Protection Act 1998 as amended from time to time

 

6. Username and password

6.1 You will be issued with a User name and password after the registration process. You are responsible for maintaining the confidentiality of the password and User name and are fully responsible for all activities which occur under your User name or password. You will not disclose your password to any other person or allow any other person access to the Site under your User name.

 

6.2 You must immediately notify ETI of any unauthorised use of your User name or password or any other breach of security.

 

7. Termination

7.1 ETI may, by notice to you having immediate, effect terminate your use of the Site (including User name and password) if ETI believes that you have acted in breach of the Terms of Use.

 

8. Links

8.1 The Site contains links to other websites or resources. ETI is not responsible for the availability of such external sites or resources and does not endorse and is not responsible or liable for any content, advertising, products or other materials on or available from such sites or resources. ETI is not responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on such external sites or resources.

 

9. Disclaimer

9.1 ETI MAKES NO WARRANTY THAT SITE WILL MEET YOUR REQUIREMENTS, NOR THAT ACCESS TO THE SITE WILL BE UNINTERRUPTED OR TIMELY, NOR THAT THE SITE WILL BE SECURE OR ERROR FREE; NOR DOES ETI MAKE ANY WARRANTY AS TO THE ACCURACY OR RELIABILITY OF ANY INFORMATION OBTAINED THROUGH THE SITE OR THAT DEFECTS IN THE SITE WILL BE CORRECTED.

 

9.2 YOU UNDERSTAND AND AGREE THAT ANY MATERIAL AND/OR DATA DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF OR FROM THE SITE IS DONE AT YOUR OWN DISCRETION AND RISK AND THAT YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OF SUCH MATERIAL AND/OR DATA.

You understand and agree that ETI does not warrant or guarantee the accuracy or completeness of any information in or provided on the Site.

 

9.4 ETI is not an agent for the individuals or organisations, whose services are displayed, mentioned or referred to on the Site. ETI does not control and is not responsible for the prices of such services, nor their availability, competency, suitability or professionalism.

9.5 The Site is a network of service providers and ETI holds no judgment on any individual person or organisation listed on the Site nor is ETI responsible for the competency or professionalism of the service provided by those listed.

 

9.6 In the event that ETI receives a complaint against an individual or organisation listed, ETI is not responsible for that individual or organisation. The Local Resources Network is just a network and ETI has no responsibility to the individual making the complaint - although ETI does have the right to remove any individual or organisation listed and cancel their membership at any time. ETI is not responsible for any member listed on the Site and an entry does not mean that ETI endorses or accredits the qualifications and/or skills of those appearing on it.

 

10. Limitation of liability

10.1 YOU AGREE THAT ETI SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES, RESULTING FROM THE USE OR THE INABILITY TO USE THE SITE OR FOR COST OF PROCUREMENT OF SUBSTITUTE SERVICES OR RESULTING FROM MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO THROUGH OR FROM THE SITE INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, USE, DATA OR OTHER INTANGIBLE ITEMS, EVEN IF ETI HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

 

10.2 YOU FURTHER AGREE THAT ETI SHALL NOT BE LIABLE FOR ANY DAMAGES ARISING FROM INTERRUPTION, SUSPENSION OR TERMINATION OF ACCESS TO THE SITE, INCLUDING BUT NOT LIMITED TO DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, WHETHER SUCH INTERRUPTION, SUSPENSION OR TERMINATION WAS JUSTIFIED OR NOT, NEGLIGENT OR INTENTIONAL, INADVERTENT OR ADVERTENT.

Any data or information which you transmit to or by using the Site is done at your own risk and we shall not be responsible for or liable for any damages or injury that may result from transmitting such information.

 

10.4 NOTHING IN THE TERMS OF USE SHALL EXCLUDE OR RESTRICT ANY LIABILITY FOR DEATH OR PERSONAL INJURY RESULTING FROM ETI’S NEGLIGENCE.

 

11. Notice

11.1 Any notice to you regarding the Site shall be made via either email or regular mail, to the address provided by you. Notices of changes to the Terms of Use or other matters may be displayed to Users generally on the Site.

 

12. General

12.1 The failure of ETI to exercise or enforce any right or provision of the Terms of Use shall not constitute a waiver of such a right or provision.

12.2 If any provision of the Terms of Use is found by a court of competent jurisdiction to be unenforceable, the other provisions of the Terms of Use shall not be affected.

 

12.3 Headings in the Terms of Use are used for convenience only and have no legal or contractual effect.

 

12.4 If any clause of these Terms of Use shall become or shall be declared by any court of competent jurisdiction to be invalid or unenforceable in any way, such invalidity or unenforceability shall in no way impair or affect any other clause, all of which shall remain in full force and effect.

 

12.5 The Terms of Use shall be governed by and construed in accordance with the laws of England and the parties submit to the non-exclusive jurisdiction of the English courts.
